TERMS OF REFERENCE
for the legal review of the Education Law of Azerbaijan Republic with particular focus inclusiveness, provision of preschool education and quality of and access to education for marginalised children
Background and Context:
Article 5 of the ?Law on Education? of Azerbaijan Republic, which was adopted on the 19th June 2009 after 15 years of debates in the national parliament, specifies that ?The State guarantees the creation of the adequate conditions required for education provision for all citizens and does not allow deprivation from any grade, level and form of education. Regardless of sex, race, skin colour, language, religion, political views, nationality, economic and social standing, origin, health conditions of citizens, the State ensures provision of education and prevention of any discrimination of citizens.? The citizens have the right to choose the type of education, educational institution and language of education.
The basis of the educational policy of Azerbaijan is to ensure equal opportunities for children from ethnic minorities, children of refugees and IDPs, also persons with disabilities while carrying out educational reforms along with ensuring a qualitative education for all citizens. The above-mentioned facts prove that the government will guarantee organization and development of an inclusive education. In the meantime, with the purpose of clarifying the indicated articles and enforcing the obligations coming forth from the Convention ?On Rights of Persons with disabilities?, there is a necessity to make changes to the ?Law on Education? of Azerbaijan Republic aimed at the organization of an inclusive education.
Despite the existing of the by-law on special education of persons with disabilities? of Azerbaijan Republic, which contains articles on special education, education at home and integrated education, the concept of ?inclusive education? has not been included to the list of main definitions in the law. The mentioned by-law provides for an ?integrated education? to ensure education of children with disabilities in secondary schools. However, the integrated education component is limited to attendance of the children with disability at secondary schools and does not envisage equal education opportunities for them. Such as, the integrated education means the education of children with disability only at secondary schools in special classrooms with special curriculums. The introduction of modern approaches on inclusive education can create greater opportunities for development of children abilities and their adaptation to social environment regardless of their existing capabilities. This approach needs to cover different levels of education. Thus, the inclusive education can help to break down the isolation.
There are 1618 preschool institutions, of which 1550 are state-run. Gross Enrolment is about 103,617 children, which is less than 20% of the population. About 13,500 staff are involved, 25% with higher education, rest mainly secondary specialised training (Teknikum).
Currently the preschool education is regulated by the by-law (article 18) from 1995, which provides for the structure of preschools, the targeting of children and powers of the Directors of preschools. The relevant Regulation is older and is considered by the Section to need updating, although it is not clear what areas are deemed problematic and it may be more pragmatic to review the whole regulatory framework. There is work going on the development of the specific by-law on the preschool education that will be based on the more recent and valid education law adopted in 2009.
Purpose of the assignment
  1. To conduct comparative legal review of Education Law of Azerbaijan Republic with specific focus on the following areas: ? Provision of Inclusive Education for children with disabilities; ? Provision of preschool education; ? Access to quality education for children vulnerable children from marginalised communities and remote areas;
  2. Recommend on relevant changes and amendments and appropriate implementation strategies based on the international experience.
Duty station: Azerbaijan (Baku)
Supervisor: Kenan Mammadli, Child Development Specialist
Major tasks to be accomplished:
The Consultant performing the Assignment had to complete the following tasks and responsibilities: ? Collect, familiarize with and analyse the information needed to perform the consultancy: ? Using the existing Azerbaijan legal education documents, samples of relevant education legislature from OECD and transition countries, analyse current provision in Azerbaijan?s education law, the actions required, including: a) Recommended amendments for Inclusive Education; b) Recommended amendments for Preschool Education; c) Recommended amendments for to improve access for children from marginalised and remote communities; d) Recommended international education legislature for modelling; e) Recommended follow-up action plan to implement the required amendments with timeframe. Outcomes and deliverables:
30 May 2012: Final report including all completed activities related to implementation of the assignment, achievements reached, comparison of work performed with work plan, and any substantial issues and recommendations.
The MOE /UNICEF will provide comments on the draft final reports within 10 days after its receipt and the Consulting agency should review the draft report based on the MOE /UNICEF comments and should submit a final report by the expiry date of the Assignment.

Qualifications or specialized knowledge/experience required:
The consultant or consulting agency should have:
? Significant experience in legal work especially legal review of education laws and legislature; ? Experience in mainstreaming gender and equity concerns in education programs; ? Doctoral (PHD) or other equivalent degree from an internationally recognized university in law with an emphasis on education; ? Minimum of ten (10) years professional experience in legal business, including at least three years of work experience in one or more of the following fields: legal review of education related laws, drafting education legislature; ? Work experience in curriculum reform in other countries in CEE/ CIS; ? Fluency in English language; ? Previous work experience with UNICEF and knowledge of UNICEF policies. Estimated cost:
Consultancy fee is to be proposed by a potential individual or organization and agreed with UNICEF in line with UN rules and regulations. 30% advance payment to be paid upon signing of the contract and 70% at the end of the contract, after clearance of the final report by UNICEF/MOE

Optoma Pico PK320 Pocket Projector

The Optoma Pico PK320 Pocket Projector ($450 street) is the brightest pico projector we?ve tested, with a good range of connections including HDMI. Using our postage scale, I weighted the projector at 0.5 pounds, while adding the power adapter brought the total weight up to just under a pound. The projector also can run off an included, removable lithium-ion cell that can last 90+ minutes in eco mode and 50+ minutes in standard mode, according to Optoma. It can fit in my pants pocket easily enough, though it takes up much of the room.

This copper-brown projector has the look of a larger projector, with the lens near the edge of one of the long sides, as opposed to the ?light saber? appearance of many picos in which the beam emerges from the middle of the narrow end. The focus wheel is in front of the lens, and is tricky to use, even if you can avoid putting a finger into the light path. On one side is the tiny power button; in back are the ports, a good selection for a pico projector: a proprietary port to fit a VGA cable; mini-HDMI; micro-USB for file transfer; AV-in, which fits an included cable with 3 RCA plugs for composite video, and an audio-out jack for headphones.

On top of the projector is a 7-button control panel, backlit with blue LEDs (though you have to quickly make a selection as the buttons soon go dark). The projector includes a tiny remote the same 7 buttons, plus buttons for Off, Bright, and for accessing VGA, HGMI, and Video sources. Working the menus can be awkward, especially at first. The controls (both on the remote and on the projector itself) make use of the arrow keys, but more often as symbol keys to access specific functions than to navigate menus. For instance, the Home screen shows six choices, each identified by a symbol: the right arrow denotes Setup, the up arrow, Music, etc.?they?re useless as arrow keys here in that you can?t scroll anywhere, but they do take you to the functions they symbolize. This takes some getting used to.

You can run presentations computer free from the projector?s 2GB of internal memory, or off of a microSD card. In addition to showing video, you can play music, show photos, or display business documents (Word, Excel, PowerPoint, or PDF) from internal memory, memory card, or thumb drive.

I tested the PK320 from about 8 feet away from our test screen, where it threw a test image about 48 inches diagonally. Image quality suffered in modest ambient light, so it?s best used in a relatively small, dark room.

Image Quality

In testing using the DisplayMate ?suite, I found the PK320?s data image quality suitable for internal presentations, say to a small workgroup?provided that the room is dark and relatively small. You could use it for presenting to potential clients in a pinch, though you might not want to use it in presentations where sharp text or exacting color is paramount. The good news is that (with the exception of an issue that I?ll soon discuss) colors were bright and reasonably true, especially yellows, which often look dull or mustardy with DLP projectors. The projector also showed less of a rainbow effect? distracting red-green-blue rainbow glints, particularly in bright areas against a dark background?than most DLP projectors.

In our text testing, images showed some blur at the two smallest sizes in both black-on-white and white-on-black text, a bit more fuzzy than is typical of a data projector. The other notable issue involved tinting in images with white or gray backgrounds.

When I set up our test unit and turned it on, I immediately noticed a pink tint in the (rather busy) image?s upper left corner. It persisted even after I?d given the projector enough time to fully warm up. In DisplayMate testing, when viewing an image that should have been uniformly white, the tinting revealed itself more fully as pinkish on the image?s left side, and greenish towards the bottom center.

The issue was notable enough that I requested a second test unit from our Optoma rep. I noticed the same issue in the second projector, though it wasn?t as severe: Only a trace of the pink showed up (in the same location), but the green was still apparent, at nearly the same intensity as with the original test unit. It showed up against white to medium gray backgrounds in data images, and with Word and Excel documents. It?s hard to say how pervasive or severe the problem is among PK320s in general based on two test units, but it?s definitely an issue worth looking out for. Optoma says that it is looking into the issue, with an eye towards correcting any irregularities they encounter.

Video Quality

I tested video quality using multiple video sources over several connections, primarily HDMI. The Optoma ML300 is okay for short clips, provided that color fidelity isn?t critical. For the most part, colors were bright and well saturated, but some tinting was apparent at times. Flesh tones tended to look reddish, and some bright areas took on a greenish tinge. Also, there was some loss of detail in bright areas. One plus is that, as was the case in data images, rainbow artifacts were nearly nonexistent and shouldn?t be an issue except maybe for people particularly sensitive to the effect.

Other Issues

The audio from the PK320?s built-in 2-watt speaker is of modest volume, not bad for a pico projector but you?ll want to be close to the projector whether you?re watching a movie or playing music. Fortunately the unit has an audio-out jack for headphones or powered external speakers.

The LED light source will last an estimated 20,000 hours, so you should never have to replace bulbs. The projector is backed by a 1-year limited warranty.

The market for micro-projectors has changed in the past year, with the influx of small LED-based projectors, palmtop sized or a little larger, in the 200 to 500 lumen range. Though there were always a few palmtop projectors, there?s now more of a continuum in side and brightness between pico projectors and ultra-portable business projectors.

The PK320 is among the largest and most powerful pico projectors, and its price is just slightly lower than the new micro-projectors (which cluster in the $500 to $600 range). The PK320 is smaller and lighter than these models, which weigh between 2 and 3 pounds. One drawback, though, is that it has an external AC adapter?which, unlike the projector, isn?t pocketable?while the LED micro-projectors have internal power supplies. The micro-projectors offer higher resolution, generally WXGA (1,280 by 800), and they?re considerably brighter than picos? though we haven?t been impressed with TI?s latest generation of DLP chips that many of them use, as they tend to introduce apparent scaling artifacts in data images that may result in softer focus.

If you?re considering the Optoma Pico PK320, you may want to look at some of these slightly larger and brighter micro-projectors such as the Optoma ML500 ?($650 street, 3.5 stars), Acer K330 ($600 street, 3.5 stars), and the more entertainment-oriented BenQ Joybee GP2 ($599 direct, 4 stars) as well. As for picos, the Editors? Choice Optoma Pico PK301 offers much of what the PK320 brings to the table at a lower price, though it lacks an HDMI connection and is only rated at 50 lumens. The Favi B1-LED-Pico ($280 street, 3.5 stars) is also a respectable choice, though it lacks a battery and so must remain yoked to a wall wart.

The Optoma Pico PK320 Pocket Projector is a powerhouse as a pico projector, bright and with a wealth of connectivity choices. However, it?s less impressive for its price now that bright micro-projectors are available for a little more money, and it still has a few image quality kinks to work out.

A new study demonstrates a link between social class and genetics in non-human primates.

Stressed-out monkeys tend to have a lower quality of life. But why? It turns out the answer might be in their genes.

Rhesus monkeys have a clear social ranking system. Those in the highest ranking group have the best access to food, water, and grooming. The opposite is also true: those in the lowest group have a difficult time when resources are scarce.

Researchers began with 49 captive female rhesus macaques of medium social rank. They sorted the monkeys into ten new groups, so that the monkeys sorted themselves into diverse social classes. Afterward, the scientists collected blood samples from the animals.

Blood samples showed a significant relationship between gene expression and social rank. So much so that, 80 percent of the time, the researchers were able to predict an individual monkey's social status just by looking at its genes.

Notably, it appeared that genes associated with the immune system were more active among low-ranking group members. This immune system activity could be tiring for the animals over time.

On the positive side, immune system activity levels did not seem fixed. As the researchers added new group members, altering the social stratification, gene expression changed. As the monkeys moved up in the world, they became less stressed.

This finding demonstrates an important linkage between the social world and individual physiology.

?If an individual is able to improve their social environment, the genome is pretty plastic, which is kind of optimistic,? Jenny Tung a geneticist at Duke University and the study's lead author told The New York Times.

In future studies, Tung plans to explore the question of the health impacts of social rank-associated gene expression.

This study appears in this week's Proceedings of the National Academy of Sciences.

WHAT IS NIA?
Nia is awakening, inspirational, intelligent, shared action, creative, playful, easy going and optimistic, well this describes a Yellow Aura, but I feel this also perfectly describes what Nia means to me hence my company name, Yellow Aura Dancing.

The first question most people have when I tell them I teach Nia is "what is that"? I find this a very challenging question as Nia is so many things and I have found that it touches each individual differently.

Techniquely speaking Nia is a sensory based movement practice. Nia combines nine classic movement techniques three from the dance arts; Modern, Jazz and Duncan Dance, three from the martial arts; Aikido, Tae Kwon Do and Tai Chi and three from the healing arts; Alexander Technique, Feldenkrais method and Yoga.

Nia is danced traditionally barefoot and to music carefully chosen to stimulate and insprire.

Putting the combination of these nine movement practices to music makes a complete mind, body, emotion and spirit fitness class.

Nia is designed to help you move in "your bodies way" which makes it a fitness class that every"body" can enjoy.

The body is designed to move and I find the balance of Nia to be the perfect way to keep the whole body flexible, agile, mobile, stable and strong. These are known as the five body sensations in the Nia Technique.

Nia is the joy of movement! Love your body, love your life!

Q. The Red Sox, Yankees, Braves and Giants all went without a victory on the first weekend of the season. Obviously, it's way too early to panic, but is there legitimate reason for concern for any of these teams?
? Wally Philips, New York

A. Yes, it's way too early to panic, but the fact is no team that started a season 0-6 has made the playoffs. So there always is urgency to perform ? and that's especially the case among the top six American League teams, one of which won't make the expanded playoff field. In fact, it may take 92-93 wins to make the playoffs in the AL this season.

Of the teams you mention, in order of reason for concern, I'd rank them Braves (very much), Red Sox (much), Giants (some) and Yankees (very little).

I've picked the Braves to finish fourth in the NL East, and nothing that has happened in their first four losses has changed my mind. In fact, through Monday, the Braves have lost their past nine regular-season games, and are 10-24 since their late-2011 collapse began. Besides the Marlins and Nationals being much-improved, the Braves have issues that I believe will drop them to the 80-84-win range.

They simply don't have enough offense ? a situation exacerbated by Chipper Jones' latest stint on the disabled list. They get little in the way of power from their outfielders (hopefully, Jason Heyward rebounds), and rookie shortstop Tyler Pasternicky may not hit enough to keep the job.

Tim Hudson also is on the disabled list, and there are questions about Jair Jurrjens' knee, so that could put too much pressure on the Braves' talented-but-young starting pitchers. You also have to wonder if the back three in the bullpen can match their 2011 workload and success.

The Red Sox's areas of concern also are well-known: Back two spots in the rotation, closer role in the wake of Andrew Bailey's thumb surgery, shortstop and both corner outfield spots ? at least until Carl Crawford returns. A team with a $160-million-or-so payroll shouldn't have that many holes, but that's the case, and it's not going to make Bobby Valentine's job any easier.

The Giants are offensively challenged. Everybody knows that. But early returns for Melky Cabrera, Pablo Sandoval and Buster Posey (the No. 2-4 hitters) are good, and I think the Giants will score more than they did last season, when they were able to win 86 games despite finishing last in the NL in runs scored.

And while the Diamondbacks will be a formidable NL West opponent, the Giants have an easier way to the playoffs in the NL than the competition among the AL's elite six teams. I don't see it taking 90 wins to make the five-team NL playoff field; somewhere in the upper-80s should be enough.

As for the Yankees, the Michael Pineda injury is unfortunate because it could have been avoided if he had told the team he was pitching through some pain. But they have enough starting pitching depth to overcome it.

Remember, Andy Pettitte should be activated next month, and you have to assume he has enough left in the tank to succeed, or he wouldn't have chosen to make a comeback.

Assuming good health for their many 30-plus stars, there's no compelling reason at this point to think the Yankees won't be back in the playoffs.

Q. Why are the Nationals so eager to move John Lannan? Won't they need him after Stephen Strasburg pitches his maximum of 160 innings? Why re-sign him in the first place in arbitration? I don't get it.
? ?Sonny Ramsey, Woodbridge, Va.

A. It's more a situation where Lannan wants to go elsewhere because he believes that he belongs in a major-league rotation.

You certainly can see Lannan's point, as while he is far from a frontline starter (38-51, 4.00 in 128 starts) he has four-plus years of big-league experience in the rotation.

But the Nationals decided this spring that Ross Detwiler, their No. 1 pick back in 2007, beat out Lannan for the final rotation spot behind Strasburg, Gio Gonzalez, Jordan Zimmermann and Edwin Jackson.

That decision came after the Nationals faced a mid-February deadline to sign Lannan in arbitration (for $5 million), or let him go. But everybody knows the adage that you can't have enough pitching, and that applies here.

Extremely rare is the team that goes through a season using only five starting pitchers, so you can rest assured that Lannan as well as Chein-Ming Wang (currently on the disabled list) will be needed at some point.

In the meantime, Lannan will have to pitch well and bide his time back in Triple-A -- unless the Nats do decide to deal him to fill another need.

Q. How did the Mets chose their team colors of blue and orange? I heard on a sports talk show that they took the colors of the Dodgers (blue) and Giants (orange) ? the two former teams of New York. Is this true?
? Charles Booth, Sun City, Ariz.

A. Yes, that is true, Charles. Blue and orange also are two of the three colors on the New York City flag. And the Mets' original 'NY' cap insignia was identical to the one on the New York Giants' caps during their final years in the Polo Grounds before moving to San Francisco in 1957.
