PHILADELPHIA This week, a strategic roadmap to help to the nation's health care system cope with the impending public health crisis caused Alzheimer's disease and related dementia will be published in Alzheimer's & Dementia: The Journal of the Alzheimer's Association. The plan aims to link the latest scientific findings with clinical care and bring together patients, families, scientists, pharmaceutical companies, regulatory agencies, and advocacy organizations behind a common set of prioritized goals. The consensus document is the outcome of a June meeting of leading Alzheimer's researchers, advocates and clinicians, who gathered as part of the Marian S. Ware Alzheimer Program at the University of Pennsylvania.

Today, 5.4 million people are living with the disease, and more than 15 million Americans are caring for persons with Alzheimer's and other dementias, according to the Alzheimer's Association. Alzheimer's disease is the sixth-leading cause of death in the United States and the only cause of death among the top 10 in the United States that cannot be prevented, cured, or even slowed.

"Our plan aims to provide good quality care for affected patients and families, advance our understanding of the pathophysiology and natural history of AD and other dementias, develop effective treatments to slow or prevent these diseases, and translate scientific advances successfully into policy and practice," the authors wrote.

The experts developed a prioritized and integrated set of recommendations after meeting in June at Penn. Four workgroups, focusing on Biomarkers, Clinical Care and Health Services Research, Drug Development and Health Economics, Policy and Ethics, had met separately leading up to the June conference. The document details recommendations from each group, and prioritizes the key recommendations from the paper, including:

  • Speed the translation of research discoveries into clinical practice by revising the regulatory process and incentivize the pharmaceutical industry to develop AD drugs.
  • Establish a diverse registry of older adults with and without dementia.
  • Develop a risk stratification model that incorporates demographic, genetic, biologic, cognitive and environmental markers.
  • Increase support to advance valuable care for patients affected with AD and their caregivers.
  • Consider legislation requiring that, until the clinical value of biomarkers is fully understood, information gained through biomarker studies cannot be considered in insurance or employment decisions.

"This plan addresses the needs of a truly responsive health-care system: to integrate healthcare and social services as well as research and educational programs that support people with Alzheimer's, family members, and other caregivers along an individualized and changing illness trajectory ," said lead author Mary Naylor, PhD, RN. Dr. Naylor is the Marian S. Ware Professor in Gerontology; Director of NewCourtland Center for Transitions and Health at the University of Pennsylvania School of Nursing.

An accompanying editorial in the journal notes that the Ware Invitational Summit document may serve as an important tool for the upcoming U.S. National Plan to Address Alzheimer's Disease, as it provides concrete, achievable policy ideas, being mindful of budget constraints and cost-effectiveness.

"Alzheimer's is an enormous and complex disease, and we believe that creative thinking, repurposing of existing funds, vigilance in reducing waste, and a constant focus on cost effectiveness will help make these recommendations a much-needed reality," said John Trojanowski, MD, PhD, senior author, director of the National Institute of Aging-funded Penn Alzheimer's Disease Core Center and is professor of Pathology and Laboratory Medicine in the Perelman School of Medicine at the University of Pennsylvania.

"The diverse perspectives collected in this report provide constructive, ethical, cost-effective guidance for policymakers," said second author Jason Karlawish, MD, associate director of the Penn Memory Center and professor of Medicine and Medical Ethics and Health Policy in the Perelman School of Medicine. "The recommendations serve as a clear roadmap to bring caregivers, researchers, clinicians, and advocacy groups together and provide them much-needed support now and in the future."

The Ware Invitational Summit brought together experts from academia; industry; government agencies and advocacy and nonprofit groups including the meeting's co-convener, The Campaign to Prevent Alzheimer's Disease by 2020. The conference and editorial assistance were supported by the Marian S. Ware 2006 CWG Charitable Lead Annuity Trust and held at the University of Pennsylvania on June 20-21, 2012.

If pieces of the plan are implemented globally - by government, private organizations and medical institutions alike - the authors' aspirations are that treatments can be developed within the next decade to improve or prevent AD; earlier diagnosis will give better options to patients ; and high-quality, effective care will be available to people with dementia throughout the course of their disease.

DNC Debacle: Florida?s Evangelicals on God and Government

Florida has one million Evangelicals who either were not registered or did not vote in the 2008 Presidential election. President Obama won Florida by a margin of 204,577 votes. The question is: Will Floridians of faith stay home or vote in November? Recent events at the DNC may hold the answer to this question. The issue is mentioning God in each parties? platform.

The Republican party?s platform refers to God 12 times. As recently as 2004 God was mentioned in the Democrat party?s platform 4 times.

Tony Perkins from the Family Research Council in an email notes:

Commenting on the absence of God in the Democratic platform, Republican Vice Presidential candidate Paul Ryan said yesterday, ?I guess you have to ask the Obama administration why they purged all this language from their platform ? I would put the onus of the burden on them to answer why they did all the purges of God.?

Last month, FRC and our allies at the Liberty Institute issued a new report cataloging 640 cases of anti-religious activity in the ?land of the free.? Now, the Democratic platform speaks of ?faith,? but not of Him in whom true faith must be placed. In a nation whose motto is, ?In God We Trust,? this is a sad commentary on the mindset of our present political leadership.

The current crisis at the Democrat National Convention (DNC) may cause Evangelicals to come to the polls on November 6th in large numbers.

The DNC took God and support for Jerusalem as the capitol of Israel out of their party platform. This change was approved by President Obama when he signed the platform. Immediately there after, this change became national news,?drowning?out the DNC message of more government, more social programs and more spending on green energy programs. When this change in the party platform became the narrative an attempt to add God and?Jerusalem?back into the platform was initiated but that led to even more controversy as many DNC delegates booed the change.

Julian Pecquet and Pete Kasperowicz from?The Hill report, ?The additions were approved by a voice vote that seemed to split the crowd evenly and confused Los Angeles Mayor Antonio Villaraigosa, who was leading the proceedings. Villaraigosa looked around the stage and appeared uncertain over how to proceed after an initial vote, in which the ?nays? to adding Jerusalem and God back into the platform sounded just as loud as the ?ayes.?

?Villaraigosa called for a second vote with similar results. He then called for a third voice vote, and while it sounded evenly split, he proclaimed that two-thirds of the delegates approved the changes, which sparked some grumbling in the audience,? note?Pecquet and Kasperowicz. All of this platform drama at the DNC was captured on video.

Perkins notes, ??The same revolutionary beliefs for which our forebears fought are still at issue around the globe?the belief that the rights of man come not from the generosity of the state, but from the hand of God.? Finally, pollster John Zogby found that 51.4 percent of voters back the GOP?s traditional marriage position that the ?ideal family is built around a stable marriage between a man and a woman.? Florida passed a?Constitutional?amendment in 2008?by 61% which defines?marriage as between one man and one woman.

Social issues are looming large in Florida.

SAN FRANCISCO, Sept. 6, 2012 -- After last year's accidental discovery of "zombie"-like bees infected with a fly parasite, SF State researchers are conducting an elaborate experiment to learn more about the plight of the honey bees.

The scientists are tagging infected bees with tiny radio trackers, and monitoring the bees' movements in and out of a specially designed hive on top of the Hensill Hall biology building on campus. At the same time, they are monitoring hives on campus and on the roof of the San Francisco Chronicle's offices for further signs of the mysterious parasite and encouraging the public to participate through a new website ZomBeeWatch.org.

After being parasitized by the Apocephalus borealis fly, the bees abandon their hives and congregate near outside lights, moving in increasingly erratic circles on the ground before dying. The phenomenon was first discovered on campus by SF Professor of Biology John Hafernik, and reported last year in the research journal PLoS ONE, with former SF State master's student Andrew Core as lead author.

It's unclear yet how big of a threat the emerging fly parasite might be to the health of honey bee colonies, or if the parasite is linked to the colony collapse disorder that has devastated honey bee colonies in the United States, say Hafernik and colleagues.

To learn more about how the parasitic fly affects the bees' behavior, the scientists have built a system to track the movements of infected bees in and out of a hive. Each bee has a set of tiny radio frequency trackers -- each no bigger than a fleck of glitter -- attached to the top of its thorax. The bees leave and return to the hive through a small tube outfitted with dual laser readers that interact with the individual trackers.

The readers, which operate in a similar way to barcode scanners in a grocery checkout lane, create "virtually a 24-hour record of bees going in and out of the hive to forage," said Christopher Quock, an SF State master's biology student working on the hive's design together with bee keeper Robert MacKimmie.

Knowing exactly when bees leave--and whether they come back--is important for understanding how and when the parasites might cause the bees to abandon their hives, Quock explained. The original study found bees disoriented and dying at night, for instance, but the researchers aren't sure whether the infected bees only leave their hives to fly in the dark.

Quock's challenge has been to create a hive design where the bees "still have room to do their normal behavior." To get a unique identification and time stamp for each bee, he said, the insects have to pass one at a time under the laser readers through a narrow passage.

Quock, who began work on the bees as an undergraduate, has also been perfecting a method for studying infected bees in the lab. "Hopefully in the long run, this information might help us understand how much of a health concern these flies are for the bees, and if they truly do impede their foraging behavior," he said. "We also want to know whether there are any weak links in the chain of interactions between these flies and honey bees that we could exploit to control the spread of this parasite."

In addition to understanding how parasitism affects foraging behavior, Andrew Zink, SF State assistant professor of biology and Quock's advisor, said that the tracking project might eventually shed light on how the infected bees behave inside the hive. "We are also interested in knowing if parasitized foragers are the recipients of aggression by other workers, for example if they're expelled from the hive, or if parasitized foragers behave in ways that disrupt hive productivity."

If enough of the parasitized bees do the wrong "waggle" dances to send unparasitized foragers off in the wrong directions for food, or distract unparasitized foragers through antagonistic interactions, the hive's productivity could falter. Combined with the premature deaths of the infected foragers, Zink said, these within-hive effects "would represent a two-fold cost of fly parasitism for the hive."

The radio tracking study "could give us a hint" as to why parasitism alters bee behavior, Hafernik said. "It might just be that having a maggot in the back is uncomfortable."

The PLoS ONE study was heavily covered in the media and some unusual outlets. "Our study got picked up on zombie discussion boards, and zombie blogs," Hafernik recalled. "And for the most part the discussion was all very respectful and zombie lovers were interested."

The researchers hope to capitalize on the interest in the bees with a citizen science project called ZomBee Watch. The project encourages bee watchers to help map the parasite's spread by uploading photos of possible parasitized bees to a central website.

Each bee has a set of tiny radio frequency trackers -- each no bigger than a fleck of glitter -- attached to the top of its thorax. The bees leave and return to the hive through a small tube outfitted with dual laser readers that interact with the individual trackers.

The readers, which operate in a similar way to barcode scanners in a grocery checkout lane, create "virtually a 24-hour record of bees going in and out of the hive to forage," said Christopher Quock, an SF State master's biology student working on the hive's design together with bee keeper Robert MacKimmie.

Knowing exactly when bees leave--and whether they come back--is important for understanding how and when the parasites might cause the bees to abandon their hives, Quock explained. The original study found bees disoriented and dying at night, for instance, but the researchers aren't sure whether the infected bees only leave their hives to fly in the dark.

Quock's challenge has been to create a hive design where the bees "still have room to do their normal behavior." To get a unique identification and time stamp for each bee, he said, the insects have to pass one at a time under the laser readers through a narrow passage.

Quock, who began work on the bees as an undergraduate, has also been perfecting a method for studying infected bees in the lab. "Hopefully in the long run, this information might help us understand how much of a health concern these flies are for the bees, and if they truly do impede their foraging behavior," he said. "We also want to know whether there are any weak links in the chain of interactions between these flies and honey bees that we could exploit to control the spread of this parasite."

In addition to understanding how parasitism affects foraging behavior, Andrew Zink, SF State assistant professor of biology and Quock's advisor, said that the tracking project might eventually shed light on how the infected bees behave inside the hive. "We are also interested in knowing if parasitized foragers are the recipients of aggression by other workers, for example if they're expelled from the hive, or if parasitized foragers behave in ways that disrupt hive productivity."

If enough of the parasitized bees do the wrong "waggle" dances to send unparasitized foragers off in the wrong directions for food, or distract unparasitized foragers through antagonistic interactions, the hive's productivity could falter. Combined with the premature deaths of the infected foragers, Zink said, these within-hive effects "would represent a two-fold cost of fly parasitism for the hive."

The radio tracking study "could give us a hint" as to why parasitism alters bee behavior, Hafernik said. "It might just be that having a maggot in the back is uncomfortable."

The PLoS ONE study was heavily covered in the media and some unusual outlets. "Our study got picked up on zombie discussion boards, and zombie blogs," Hafernik recalled. "And for the most part the discussion was all very respectful and zombie lovers were interested."

The researchers hope to capitalize on the interest in the bees with a citizen science project called ZomBee Watch. The project encourages bee watchers to help map the parasite's spread by uploading photos of possible parasitized bees to a central website.

Insight: Taking on the "toga-wearing bandits" in Brazil's courts

BRASILIA (Reuters) - Eliana Calmon takes great delight in provoking people. But even she didn't realize at first what a bomb she had dropped.

"Look, I use a lot of colorful language, so when I said it, it didn't seem that bad. But then the interview ended," she recalled, starting to chuckle, "and I peered over at my aide, and he looked like he had seen a ghost! ... And that was when the whole storm started."

The offending phrase: Calmon, who serves as a kind of ombudswoman for Brazil's judicial system, said her work was being undermined by "bandits who hide behind their togas" -- corrupt judges who, she said, favor special interests and line their pockets with cash while doing as little work as possible.

The florid accusation, made in a newspaper interview last year, unleashed a scandal that went all the way to the Supreme Court. The surprising outcome has been an unprecedented wave of transparency and reform in Brazil's courts -- many of which have historically behaved like private fiefdoms, mistrusted by Brazilians and foreign investors alike.

The confrontation has turned Calmon, a 67-year-old career judge, grandmother of two and an author of a popular cookbook, into an unlikely cult hero -- with more than 10,000 fans on Facebook and even a float in this year's Carnival parade in her honor.

Her rise has shaken a genteel world dominated by gray-haired men who often sprinkle their speech with Latin phrases and elaborate honorifics. With a taste for bright blazers, and a habit of punctuating her criticisms with a pealing laugh, Calmon has described corrupt judges as "vagabonds" and "termites," said Brazil's legal system is "a century behind," and called for a "war" to bring greater accountability to the bench.

Despite those who accuse her of being a publicity hound -- or, at worst, a loudmouth who carelessly slanders the entire judicial system -- Calmon says it is her grass-roots support that has given her the authority to press ahead.

In recent months, she has forced judges to disclose more data about their finances, curtailed practices that allowed officials to earn unwarranted salary bonuses, and pushed several corrupt officials out of their jobs -- and she's not done yet.

Her efforts are part of a larger trend as Brazil becomes more prosperous and its growing middle class demands better institutions. Six ministers in President Dilma Rousseff's government resigned or were fired last year because of corruption charges -- an unprecedented purge. Yet the judiciary was seen as a laggard, the branch of government that had changed least since Brazil's military dictatorship ended in 1985.

What Calmon has done "is crucial for Brazilian democracy," says Fernando Henrique Cardoso, who as president from 1995 to 2003 helped consolidate civilian rule. "These judges never had any controls on them before."

It all would have been impossible, Calmon says, without that first rhetorical salvo.

"When I said 'toga-wearing bandits,' it was to a very tiny newspaper," she said. "But, in today's world, if you say something that is already on people's minds, it explodes like gunpowder. This, I've found out, was something that everybody believed, but couldn't say out loud. It was my role to say it."

INEFFICIENT JUDICIAL SYSTEM

That's how things look now. But just a few months ago, it looked like Calmon was going to lose -- and lose spectacularly.

Two days after making the "toga" comment, Calmon was obliged to sit silently in the same room as Antonio Cezar Peluso, then the head of Brazil's Supreme Court, as he read a statement "vehemently repudiating" her comments for "impugning the honor ... of thousands of honest judges throughout Brazil."

Calmon counters that, by focusing public shame on corrupt judges and rooting them out, she was trying to help the "vast majority" of Brazilian magistrates who are honest and hard-working. But on that particular day, she kept her mouth shut.

"I knew it wasn't my moment," Calmon says. "And I knew things were going to get worse."

Indeed, within weeks, the heat was turned up further -- when the Supreme Court took up a case that sought to effectively neuter Calmon's powers to investigate and censure judges.

It wasn't her first clash with the system. Raised in Bahia, a state in the impoverished northeast, Calmon says she studied law because, like many who came of age during the 1960s, she wanted to help address the injustices that made Brazil one of the world's most socially and economically unequal countries.

Yet when she became a judge, she was appalled to find one of the most entrenched bastions of Brazil's elite. The legal system, which is based on Napoleonic code and has its roots in the Portuguese colonial era, has traditionally "been impervious to those who try to lift the cloak and force changes," said Pedro Taques, a senator who has championed legal reform.

"It's a club," Taques says. "Eliana was daring enough to demand entry, even when many didn't want her."

The Constitution of 1988, written shortly after democracy was restored, granted courts near-total autonomy -- a move that was designed to shield them from political interference but in practice made it easier for judges to conceal nepotism, graft and decisions that favored special interests, Calmon says.

The slow pace and opaque functioning of the legal system is regularly cited in surveys as one of the biggest obstacles to investing here. In the World Bank's annual Doing Business study, which ranks 183 countries based on their friendliness to investors, Brazil sits near the bottom third in categories including enforcing contracts, starting a business and dealing with construction permits -- all areas where courts play a role.

"There's corruption, of course ... but we also have huge areas in the legal system that feed off of dysfunction and inefficiency," Calmon says, citing the Brazilian practice of requiring extensive notarization of documents as one example. "If the justice system worked well, these interests would be decimated. So they do everything possible to create disorder."

Calmon's candor has burned a lot of bridges, but it also made her powerful friends -- fellow reformers who helped her ascend through the ranks. She became the first woman to serve on the STJ, a superior federal court. And in 2010, she was appointed to her current role, a senior position on the National Council of Justice (CNJ) -- a special body created six years earlier with new powers to investigate judges.

"Throughout my career, I always denounced everything I saw, even when it wasn't politically correct," Calmon said. She started to laugh. "If they had wanted a little mouse for the CNJ, I guess they should have picked somebody else."

SHOWDOWN WITH THE SUPREME COURT

So, true to form, after the Supreme Court took up the case to limit the CNJ's powers, Calmon doubled down.

She took her accusations directly to the public -- alleging, for example, that hundreds of judges had made financial transfers in excess of their income. She also said more than half of judges in S?o Paulo state had failed to file income tax returns, despite being legally required to do so.

Meanwhile, she took direct aim at Peluso, the head of the Supreme Court, implying that he was preventing her from investigating courts in his home state of S?o Paulo -- where 60 percent of cases in Brazil are heard.

"You know when I'll get to inspect S?o Paulo? It'll be the day that Sergeant Garcia finally catches Zorro," she said, referring to the hapless police officer and elusive masked criminal from the popular 1950s TV show.

The public response was overwhelming. Calmon seemed to be on the front pages of newspapers every day. Social media lit up with every new accusation. Finally, she reached possibly the apex of fame and adulation in Brazil -- a Carnival float in Brasilia with a banner that said, roughly translated: "Eliana Calmon, your patron saint is bad-ass!"

In February, the Supreme Court ruled on the case, preserving the powers of Calmon and the CNJ. Calmon, who was so nervous during the hearing that she took pills to sleep at night, was shocked. "I have no doubt that public opinion played a role in the decision," she said.

Layrce de Lima, a spokeswoman for the Supreme Court, declined requests for comment on whether the CNJ ruling was influenced by public pressure.

After emerging victorious from the showdown, Calmon says the floodgates opened up. Prosecutors and legal officials all over the country, especially those under the age of 40, began to contact her with tales of corruption and abuse of power.

"The real benefit of the confrontation was the dramatic increase in the number of allegations we received at the CNJ," Calmon says. "People began to believe for the first time that nobody -- not even the powerful -- could stop these cases from being investigated."

Based on the information, the CNJ has limited practices such as judges claiming up to three months of vacation a year, or giving themselves and their staff dubious bonuses. Calmon has also begun to limit a common practice in which money for financial awards in legal cases was kept in court-controlled escrow accounts for years -- which in some instances allowed court officials to skim the accrued interest for themselves.

Mauro Zaque, a young prosecutor who has investigated corrupt officials in the state of Mato Grosso, used a soccer metaphor to express his admiration. "We've all watched as Eliana kicks the ball with all her strength, and scores many goals ... She has inspired many of us to get out there on the field as well."

NEXT GENERATION OF JUDGES

Then, in August, a funny thing happened -- Sergeant Garcia finally caught Zorro.

Flanked by a dozen colleagues from the CNJ, Calmon walked into the Court of Justice of the State of S?o Paulo -- an imposing, Depression-era building where the halls are lined with photos of judges, nearly all of them male. "This is extraordinary," she whispered to a colleague.

She spent the day in meetings with judges and other legal officials -- some of whom, six months before, had been after her scalp. The conversations took on an air of confession -- complaints ranged from the slow pace of court hearings to judges suspected of padding their payrolls with friends. One lawyer sought advice on how to start a CNJ-like body for S?o Paulo.

"People out there know what's going on now," Calmon solemnly told one group of prosecutors. "If we deny what's happening, that will be the end of all of us. We can only improve if we admit we have faults."

Calmon's last day on the CNJ is Friday. But, in a sign of just how far she's come, Calmon was elected this week by her fellow federal judges to head a well-regarded school for young magistrates -- a job that will allow her to shape the next generation of Brazil's judiciary.

It is also clear that her role as the moral conscience of Brazil's judicial system has grown beyond her job title. When the Supreme Court began a corruption trial of several powerful officials from the ruling party in August, Calmon said that "all of society" would be watching how the judges ruled. Her warning was in several newspapers the next morning.

Even those from the club that previously opposed her say there has been a clear -- and likely lasting -- change.

"People were uneasy, of course, about her accusations. But the consequences are irreversible," said Armando Sergio Prado de Toledo, a judge and director of the school of magistrates in S?o Paulo. "Courts will have to be cautious now, because they know that because of her, everything they do will be monitored by the media, which has society behind them."

He smiled. "I think it's marvelous, and long overdue. The truth, is we needed this."

It's not just the big-time football powers that have trouble with the behavior of their athletes. Boston University has issued a report into sexual assault charges against a pair of players on the hockey team in which it says "a culture of sexual entitlement exists among some players on the men?s ice hockey team, stemming in part from their elevated social status on campus."

The report was ordered up by the school administration after back-to-back incidents last season that led to sexual assault charges. Corey Trevino, a 2008 draft pick of the New York Islanders, pleaded guilty to assault. Rape charges against Max Nicastro, who is the property of the Detroit Red Wings, were dropped. Neither player remains in school.

The report says it doesn't attempt to judge the guilt or innocence of the players, but rather look into "whether inherent aspects of the program's culture and climate could have helped to foster the actions that led to the criminal charges."?

BU is an interesting case. The school doesn't have a football team; it eliminated the program in 1997. But that only confirmed what most everybody already knew: BU is a hockey school, with five NCAA titles, 21 appearances in the collegiate Frozen Four and the longtime domination of the Hockey East conference and the annual battle for Boston's bragging rights called the Beanpot.?

The report acknowledges hockey's special status on campus:
For those unfamiliar with Boston University athletic programs, the men?s hockey team, which has won a total of five national championships, has garnered substantial national recognition and is often among the top university ice hockey programs in the nation. Its visibility both on and off campus exceeds that of any other BU athletic program.

The report also noted that hockey is an unusual situation, in that players are often drafted before they attend college. That calls into question, perhaps even more than in other sports where a pro career might be assumed, the players' commitment to their academics. In its conclusion, though, the report hit the school for a lack of sufficient institutional control over its flagship athletic program.

There are a number of important structures and processes that are failing to achieve the full level and quality of oversight of the men?s ice hockey program that is expected and appropriate at a major university. These failings include issues of institutional control and governance structure at the highest levels, as well as shortcomings in leadership at the team level. Further, the absence of a few routine, transparent, and systematic processes that would establish clear expectations for players? behavior has created a culture in which important aspects of oversight for our student-athletes? behavior?beyond performance as a team member?has fallen inappropriately to the coaching staff.

The report said its outside investigator, Michael Glazier, chair of the Collegiate Sports Practice Group in the firm of Bond, Schoeneck & King, PLLC, "found no evidence of major NCAA violations."

A bill opposing the shackling of pregnant prisoners, AB 2530,?has been passed unanimously by the California State Legislature and is now on Governor Jerry Brown?s desk, with thirty days to either approve or veto it. Last year, a previous version of this bill was also passed unanimously by the Legislature, but it was ultimately vetoed by Governor Brown. With Governor Brown?s decision expected anytime, local activists are urgently mobilizing to stop him from vetoing this important bill once again. AB 2530 supporters have created a webpage for the public (not just California residents) to contact the Governor. Take action here.


The action page states that ?AB 2530 addresses Governor Brown?s veto by clarifying language and prohibiting the most dangerous forms of shackling. The American College of Obstetricians and Gynecologists (ACOG) opposes the use of shackles on pregnant women in all but the most extreme circumstances. Pregnant women in correctional facilities are more likely to experience miscarriage, preterm birth, low birth weight infants, and potentially fatal conditions like preeclampsia. Excessive shackling could not only increase stress and lead to further complications, but also render doctors unable to treat women in emergency situations. AB 2530 provides medical professionals the authority to have restraints removed in order to treat pregnant inmates.?

Tina Reynolds and Victoria Law of Birthing Behind Bars:???? Imagine a woman who is actively in labor. She is handcuffed. Attached to those handcuffs is a chain that links the handcuffs to a chain that goes around her belly. Attached to that belly chain is a chain connected to shackles around her feet. This hampers her movement tremendously.

If you've ever seen old movies depicting chain gangs or prisons, you've seen some version of shackling. When people who have their legs shackled attempt to move, they hobble slowly since the leg shackles keep their feet and legs together. You can imagine how dangerous this is for a woman who is actively in labor and is going to need to both move around and eventually be able to push a baby out of her body.

A3N:???? What arguments do you make in opposition to this?

BBB:???? First, shackling or otherwise restraining a person who is in labor and delivery is inhumane, if not torture. International organizations have recognized this as a human rights abuse. In 2006, the UN Committee Against Torture alerted the US government that shackling during childbirth is a violation of the UN Convention Against Torture, which the US is a signatory of. It should also be noted that Rule 33 of the UN?s Standard Minimum Rules on the Treatment of Prisoners states clearly that chains and/or irons should never be used as restraints.

Secondly, shackling or otherwise restraining a person in labor and delivery is dangerous both to the woman and to the baby. Medical professionals have recognized and spoken out against these practices: The American Medical Association adopted a resolution opposing shackling as a medically hazardous practice. The American College of Obstetrician and Gynecologists, the American College of Nurse Midwives, and the American Public Health Association have also condemned this practice.

A3N:???? How often are pregnant women prisoners forced to wear shackles during birth? Is there documentation of how many pregnant prisoners are forced to do this?

BBB:? ? As far as we know, there is no documented percentage (that is publicly available) of how many women prisoners are shackled during birth. What we do know is that 34 states currently have no protection against shackling pregnant prisoners while they are in labor or delivery. That means that it is up to the jail or prison staff as to how and if the mother will be restrained while she is in labor, while she is being transported from the jail or prison to the hospital, and how she will be restrained once at the hospital.

In addition, mothers undergoing delivery via c-section are often restrained both during and after the surgery. These decisions are not made by the medical staff. As of 2011, in many of the states that have no protections against shackling and restraining women during childbirth, the input of medical staff does not need to be considered.

We also know that five to six percent of women entering jails and prisons each year are pregnant. Many will spend the duration of their pregnancies behind bars, which means that even if they do not give birth while incarcerated, they must rely on the prison?s prenatal care, which is often inadequate and sometimes can jeopardize their pregnancies.

A3N: ? ? Compared to shackling the legs, how much safer is shackling of the hands, or any other method used? Do you know often these are used instead?

BBB:???? We?re not sure how often other methods are used instead of leg shackles during childbirth, but part of the campaign is recognizing that using restraints on a woman who is pregnant and/or actively in labor and childbirth is dangerous.

For example, in Massachusetts, the Massachusetts Department of Corrections has stated that they do not shackle women who are in labor (thus anti-shackling legislation is unnecessary). Their current policy is that the restraints used on women who are in labor and delivery should be the ?least restrictive? and should not be waist or leg restraints. But this doesn?t mean that there aren?t dangers to restricting a pregnant women?s movement. When walking, pregnant women, especially in their third trimester may have balance issues, and if they trip and fall while handcuffed, they will be unable to catch themselves. When transported in a van while handcuffed, if jostled, they will be unable to catch themselves from falling or bumping into something.

It?s also important to note that Massachusetts?s ?less restrictive? policies came about because of a 1992 consent decree, McDonald v. Fair?(CivilAction No. 80352), not because the Department of Corrections realized the hazards and immorality of shackling pregnant women. It?s important to remember that we cannot wait for prison administrators and legislators to see the light; we have to constantly remind them that shackling pregnant prisoners is not only a medical issue, but also a human rights abuse that will not be tolerated.

A3N: ? ? Who are the primary advocates of shackling pregnant prisoners?

BBB: ? ? The primary advocates of shackling are prison and jail staff (and their unions). Because prison and jail staff have very strong trade unions, whereas prisoners are not a voting constituency, politicians sometimes jump on pro-shackling as a way to court those votes.

Last year, pressure from the California State Sheriffs' Association and both Alameda and Sonoma County Sheriffs' departments pushed Governor Brown to veto the anti-shackling bill that had already passed the State Senate and Assembly. Similarly, in Massachusetts and Georgia, the state Department of Corrections has opposed the efforts of advocates and formerly incarcerated women trying to pass legislation to ban the shackling and other restraints of incarcerated women during labor, delivery and recovery.

A3N: ? ? What arguments do shackling advocates make?

BBB:???? The most commonly-used argument is that, if not shackled or restrained, women who are actively in labor and delivery will use the opportunity to overpower the guards and escape. As I mentioned earlier, legislators have jumped on that bandwagon, sometimes to court the votes of prison and jail staff, sometimes simply playing on law-and-order rhetoric. In Rhode Island, when the state legislature was considering its anti-shackling legislation in 2011, House Minority Leader Brain Newberry was quoted as saying, ?You could have a murderer who is pregnant. The easiest time to escape is during transport.?

Of course, this is fear-mongering and not at all based in reality, as anyone who has ever experienced labor and delivery (whether incarcerated or not) will tell you. We have publicly countered this argument both from Tina?s own experience as a pregnant prisoner and from listening to countless stories of others who have given birth in prison. We have never heard a woman tell a story of wanting to run during labor. It's just not on their mind.

Vikki has gone through childbirth (but not in prison), and can tell you that when she was actively in labor, she couldn?t even walk down the hallway without lots of physical support from her partner (and even then it seemed like a herculean challenge). We seriously doubt that a woman in labor is going to summon up the strength to overpower the accompanying guards and medical staff and then run. All of the mothers that we know will tell you the same.


There's also the perception that, when a person has violated the law and is sent to prison, she deserves all other punishments that come along with her prison sentence. Women prisoners have historically been viewed as not redeemable and this notion still comes into play when we think about women in prison today.

In addition, shackling during transportation outside of prison is practiced regardless of gender. There is no consideration of circumstances and so the health and safety of pregnant women are ignored by this blanket policy.

A3N:???? California?s AB 2530 opposes shackling ?unless deemed necessary for the safety and security of the inmate, the staff, or the public.? How serious of a loophole is this qualification? How significant of a step forward do you think this bill is?

BBB:???? The bill is significant because it prevents the CDCR from shackling and restraining women during any stage of their pregnancy, not just during labor, delivery and recovery. It also forces the CDCR to inform women that they have a right not to be shackled or cuffed behind the back during the entirety of their pregnancies.

The "unless deemed necessary for the safety and security" clause addresses the fears that prison and jail staff (and their unions) whip up around not being able to restrain women in labor. Of course, it would be nice if it weren't there, but that clause may also mean that jail and prison staff actually have to record the (hopefully few to no) instances in which they do use restraints on pregnant women and actually justify their actions. It's not perfect, but it is a start.

A3N: ? ? How far have other states? anti-shackling bills gone with their restrictions on shackling?

BBB: ? ? In 1999, Illinois was the first state to pass anti-shackling legislation--banning restraints of any kind, including handcuffs and leg irons, from being used on women who were either in labor or being taken to the hospital to give birth. However, prison and jail officials often interpreted labor to mean only the actual delivery, not the hours and sometimes days in labor leading up to childbirth. This meant that pregnant women were still shackled for unnecessarily long periods of time.

This past January, following a $4.1 million settlement (thanks to the efforts of Chicago Legal Aid to Incarcerated Mothers, who filed a federal lawsuit on behalf of several women that had been shackled up until the moment of delivery), Illinois passed another bill that clarified its definitions of labor and delivery. It also extended the ban on shackling and restraining pregnant women incarcerated at Chicago's Cook County Jail during all stages of their pregnancy. Several other states have anti-shackling legislation that extends beyond the immediate time period of labor, delivery and postpartum recovery. Vermont?s 2005 anti-shackling legislation states that prison staff "shall not routinely restrain pregnant inmates who are beyond their first trimester of pregnancy in the same manner as other inmates, recognizing that to do so might pose undue health risks for the mother and unborn child."? Like legislation in other states, Vermont also prohibits shackling of women during labor and delivery EXCEPT when the prison or jail staff feel that "the inmate presents a substantial flight risk or other extraordinary circumstances dictate otherwise." Similarly, New Mexico's 2009 legislation states that a "correctional facility, detention center or local jail shall use the least restrictive restraints necessary when the facility has actual or constructive knowledge that an inmate is in the second or third trimester of pregnancy." Again, the legislation allows for exceptions if the prison or jail staff determine that the woman poses some sort of security risk.

When Rhode Island passed its anti-shackling legislation in 2011, it included a prohibition against restraints starting in the second trimester, a requirement that pregnant prisoners be notified of their rights, and a provision allowing women to file a lawsuit if they are shackled in violation of the law. This last rule is not in any other legislation limiting or prohibiting shackling.

However, all of these bills have exceptions that justify shackling for "safety reasons." As far as we know, the "for safety reasons" exceptions have not been addressed by people inside women's prisons or by outside advocates who have been pushing anti-shackling legislation.

A3N: ? ? Anything else to add regarding the significance of AB 2530 in California?

BBB: ? ? The California bill is significant because it would extend the prohibition on using leg irons, waist chains or handcuffs behind the body on pregnant women throughout their pregnancy (and recovery from childbirth), not just in the hours during labor and delivery. It recognizes that restraining pregnant women, no matter what trimester of pregnancy that they are in, is both medically dangerous and a human rights abuse.

Because there's been more national media attention paid to efforts to pass it, the legislation would also be a model for advocates in other states seeking similar protections for pregnant people in jails, prisons and immigrant detention centers in their areas. As we said earlier, 34 states currently have no legislative protection against shackling or restraining pregnant women during labor and delivery. Of the states that do have legislative protection against shackling or otherwise restraining people during labor, only a few protect women during earlier stages of pregnancy.

We?re working with the media group Thousand Kites to build a system to contact supporters in certain areas when we know that campaigns addressing reproductive justice in prisons are happening in their home towns or states.

We recognize that campaigns to end shackling and other reproductive injustices in prison can?t happen without the women who have been most directly impacted. In 2009, New York State passed legislation to end the shackling of incarcerated women during labor, delivery and recovery. Crucial to the passing of that bill were the voices, insights and analyses of women who had experienced birth behind bars. Members of WORTH, an organization of currently and formerly incarcerated women in New York, spoke about being pregnant while in jail and prison, being handcuffed and shackled while in labor, and being separated from their newborn babies almost immediately. Their stories drew public attention to the issue and put human faces on the pending legislation.

From this victory, WORTH members gained a deeper sense of their own power to affect social change. Birthing Behind Bars comes out of this recognition that those most directly impacted must be at the center of the fight for reproductive justice in prisons.

The Birthing Behind Bars site provides a forum for women's stories and a way to amplify them to support campaigns for reproductive justice. If you are a formerly incarcerated woman who has experienced pregnancy while behind bars, or if you know a sister who has, get in touch! We want to hear your stories! We also need to recognize that reproductive justice is not simply the absence of chains and irons during labor and delivery, but that everyone, regardless of what stage of pregnancy they?re in, deserves to have a safe and healthy pregnancy. We recognize that prisons are never going to provide a place for safe and healthy pregnancies; we recognize that we need alternatives to incarceration for pregnant women. At the same time, we also recognize that the city, state and federal systems continue to incarcerate women at all stages of pregnancy. While they are behind bars, they should be protected against the human rights abuses and reproductive injustices currently inflicted upon them.
